This policy, along with the Maze Digital General Terms & Conditions of Service and any Specific Terms and Conditions of Service, form the Agreement between you (the “Customer”) and Maze Digital SRL. (“Maze Digital”/”We”) together (the “Agreement”).

Definitions

“Services” means the services and or products to be provided to You by Maze Digital.

1. General

Maze Digital reserves the right to suspend or cancel a customer's access to any or all Services provided by Maze Digital if Maze Digital determines that an account has been misused. Maze Digital may also deny Services and/or access to its servers to anyone at its discretion.

2. Customer obligations

2.1 You will make complete and secure backups of your computer programs, database and records every day or more often if best computing practice requires it;

2.2 To avoid exceeding the data-transfer volume limits, You agree to regularly check all your email accounts and download the emails stored there. You understand that Maze Digital may, if your email boxes go over their capacity at any time, send back all the emails that come after that to the senders without telling You.

2.3 You will not share any passwords that Maze Digital gives you for the Services and tell Us right away if you find out that someone else knows a password.

3. Use of the Services

3.1 You will use the Services only for a legal and proper purpose.

3.2 You will do your own tests for computer viruses following best computing practice before every time you use the Services.

3.3 You will make sure that your website follows all the relevant laws and obligations in any place where you are located or where your website can be accessed or made available. You must also get any relevant permissions and approvals for installing and using any third party equipment or software. Maze Digital will not be responsible under this Agreement if you fail to follow any such relevant laws or obligations or do not get such permissions or approvals.

3.4 You shall always use Web Site Space only as a normal Web Site. You shall not use the Web Site Space or Your Services in any way that may cause too much load on the Maze Digital Equipment, such as but not limited to installing or running web proxies, using your allotted space as online backup or storage, or mirroring mass downloads.

3.5 We have the right to deny any and all Services or access to our servers at any time at our choice.

3.6 We do not allow any content on our servers that goes against this Agreement. We have the right to remove such content, suspend and/or cancel the Services right away if we think that such content breaks this Agreement.

3.7 You agree that your use of a web hosting package with unlimited web space will follow the terms of this Agreement and You promise that You will follow this Agreement.

3.8 Quotas and Limits.

The available web space capacity will be checked once a day and any customer that needs an increase, will be told about extra charges.

Maze Digital has the right to move customers to servers that are more fit for that customer's usage, in Maze Digital only choice, and the customer agrees and understands that during any such move some or all of the Maze Digital services may not be available or reachable.

Maze Digital has specific quotas for using its hosting Services. All web hosting and WordPress hosting plans, have a limit of no more than 262,144 inodes per account. It is your job to make sure your account stays below this limit, and you can also ask us your hosting account status. The hosting quota is a combination of all files stored on your web space.

3.9 We will tell You if we find out about any alleged breaking by You of this Agreement.

3.10 We have the right to move your data to a different server without telling You or any third parties before.

3.11 If your use of the Services causes too much load on Maze Digital systems, then we may suspend your account at our only choice until the reason for any such overload (allowed or not) is found out.

3.12 You shall pay Us back for all damages, losses and expenses that come from any action or claim related to any breaking of this Agreement by You.

3.13 If we remove your data or content and/or suspend some or all Services and later put back such content and/or start again the Services, Maze Digital will not be responsible for any damages, losses or expenses that come from such action. 4. Unacceptable Use of the Services

4.1 You will not send, share, copy, resend, broadcast or publish (directly or indirectly) in any form any data, information or contractual rights, material or statement that breaks the Intellectual Property Rights or contractual or legal rights of any person or entity or the laws or legal rules about defamation, contempt, blasphemy, breaking of privacy or personal data rights and any similar or related laws in any place where they are or may be accessed or made available;

4.2 You will not use the Services to send or make to be sent or forwarded electronic mail without the clear or assumed agreement of the respective receiver. This includes but is not limited to not sending many electronic mails with the same content which is often called “spamming”;

4.3 Use of the IMAP account as a “virtual drive”, that is, to store files as attachments or in any other way, is not allowed at all. IMAP accounts may be used for no reason other than in the context of normal email traffic;

4.4 You will not use the Services to get or offer or let to be offered for money or otherwise any material, images, displays or services that are offensive, illegal or immoral or that break any legal obligation;

4.5 You will not use the Services to get or offer or let to be offered for money or otherwise any material, images, displays or services that have any adult material. Adult material includes all pornography; or otherwise dirty or obscene content. The choice of ‘adult material' is left completely to Us.

4.6 You will not make your home page(s) in a way that leads to a risk of or causes too much load on the server given by Us in connection with the Services;

4.7 You understand that if You go over the relevant data transfer volume that applies to specified Services you will have to pay extra charges as may change from time to time for the data transfer volume going over the agreed level in the specified Service;

4.8 You will not use the Services in a way that breaks any third party's copyright or other intellectual property rights;

4.9 You must make sure that any use of Maze Digital services by You or any other allowed account user, are not knowingly or carelessly used for i.e. making, sending, going over the quota limit, publishing or uploading any electronic material (including, without limit, files that have viruses, corrupted files, Trojans or any other similar software or program) which is known or likely to cause, stop, damage, destroy or limit how Maze Digital services or any other Internet user or person work; and

4.10 You must make sure that any content sent by end-users such as forum posts or chat room entries meet with the standards set in this Agreement.

4.11 The use of all Shutterstock Content follows the terms of this Agreement, and you may not use the Shutterstock Content: (i) with defamatory, pornographic, or unlawful content; (ii) in a way that breaks any third party's trademark, copyright, or other intellectual property rights, alone or together with your content or data; (iii) in a way that shows any person appearing in the Shutterstock Content to advertise adult entertainment clubs, escort services, or similar places or services, or doing unlawful or criminal activities; (iv) as a trademark, service mark, logo, or other sign of origin, or part of it, or to otherwise support or imply the support of any goods and/or services. You may not use the Licensed Content separate and apart from website creation, hosting, online marketing, or related services given to you via the Maze Digital systems or network or using the Maze Digital services.

5. The Software

5.1 The Maze Digital Online Software (“Software”) is given for online use as part of the Services, and the use of the Software may have fees as shown in the current fee schedule for the specified Services;

5.2 The Software is hosted software, which works directly on Maze Digital servers, and You agree that you will not get, install, keep, make copies of or sub-licence the Software. You also agree that You will not in any way change, break down, reverse engineer, take apart, change, copy, rent, lease, lend, licence, share, sell or otherwise get rid of any part of the Software or any copies of it and will not help any third party do so; and

5.3 You understand and agree that the Software is made to be used through Maze Digital user interface and, as such, may be used by any allowed user from any computer or workstation. This licence is automatically ended when this Agreement ends. Maze Digital has the right to change or stop the Software at any time without telling you.

6. Enforcement

6.1 Maze Digital will decide, at our own choice, whether you have broken this Agreement through your use of Maze Digital Services. When a breaking of this Agreement has happened, we may take any such action as we think is right in line with section 1.1 of this Agreement;

6.2 Not following this Agreement is a serious breaking of the Agreement that lets you use Maze Digital Services, and may result in Maze Digital taking all or any of the following actions:

6.2.1 immediate, temporary or permanent stopping of your right to use Maze Digital Services;

6.2.2 immediate, temporary or permanent removal or saving of any content that breaks this Agreement uploaded to Maze Digital servers

6.2.3 giving You a warning;

6.2.4 starting legal proceedings against You for paying back all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) that come from the breaking;

6.2.5 more legal action against You; or

6.2.6 sharing such information with law enforcement authorities as Maze Digital thinks to be reasonably needed; and

6.3 Maze Digital do not accept responsibility for actions taken in response to breakings of this Agreement. The responses described in this policy are not limited, and we may take any other action we reasonably think is right.

7. General

Maze Digital will cooperate with the police and all law enforcement and government agencies if we are required by law.
