General Terms and Conditions for Maintained Web Hosting or Maintained Server Packages
By purchasing a service from Maze Digital SRL. (We, Us, Our), You (Customer) agree to these terms and conditions. The provisions contained in this document incorporate and are supplemental to General Terms and Conditions and Acceptable use policy, by which you are also bound by.
General Terms
1. Your Obligations
1.1. Data Backup Obligations
You are obliged to back up Your data in accordance with Our General Terms and Conditions.
1.2. Obligation to Inform
If You have reason to believe that a third party is using Your platform or web hosting space without authorisation, You are obliged to inform us immediately.
1.3. Fair Play Obligations
You agree to neither offer nor disseminate copyrighted content without authorisation. You agree to not use P2P exchanges, download services or streaming services over which copyrighted materials might be illegally disseminated. You agree to not provide links that point to P2P exchanges, download services, streaming services or their contents.
1.4. Fair Use Obligations
You agree to avoid the excessive consumption of resources. Decisive factors are a drop in performance of the platform/server, suspicion of fraudulent behaviour (Fraud) or impairment of the rights of third parties. Furthermore, you agree to avoid any disruption that would lead to a drop in performance of the platform on which the resource is located and that would affect the provision of the service or the rights of third parties sharing the infrastructure.
1.5. Crypto Mining
You agree not to use the resources and servers provided by Maze Digital to operate applications for mining cryptocurrencies.
1.6. Liability
If the service purchased supports importing and installing operating systems, images and other external content, this is done at your own risk. We assume no liability for third party content and applications and damage resulting from the installation and use of third party materials.
1.7. Obligations to Co-operate
You agree to follow the technical instructions provided by Us.
You agree to co-operate and follow Maze Digital instructions regarding software upgrades for the purposes of maintaining the security and stability of the services provided.
We accept no liability for the consequences resulting from failure to do so.
1.8. License Obligations
You agree to fulfil all the license requirements, including those from third parties.
You must remain in possession of the required original software licenses. We may request proof of licenses at any time.
2. Our rights
2.1. Migration Rights
We have the right, if so required, to migrate Your server, Your Web Site, the server software or parts for technical or security reasons (e.g. end of life of the software, end of support).
We reserve the right to offer a different version of the application that We consider most appropriate and to modify the available applications, at any time in line with new versions or in cases where weaknesses are detected. We shall notify you via email of these changes.
2.2. Access and Cancellation Rights
We reserve the right to disconnect the server from the network or disable the website without prior notice, if You have breached Your obligations. You will be immediately notified if such action is taken via email.
If You have breached Your obligations, We reserve the right to cancel your contract without notice.
2.3 Depending on the package purchased, you might not have administrative access / rights to the hosting account or server. This does not limit your capability to manage your website through the dedicated website backend panel, if your website is build on a platform that has this option (Examples of platforms with backend/ management panels: WordPress, Magento, OpenCart and so on).
2.4 We have the right to temporarily disable your website during our general maintenance process, without notification and at any moment and for any amount of time we need. We will try and conduct general maintenance during 1am and 5am London time zone.
3. Our Obligations
3.1 We provide you with the platform required for Your application/ Your web site and update it as necessary. The platform includes the operating system and all requested services.
3.2 We will schedule updates to Your platform and any necessary plugins/modules, a minimum of four (4) times a year during the minimum contract duration of 1 year and we will try and notify You each time after the maintenance has been finalised.
3.3 Updates to plugins / modules will be done only to those plugins / modules that We or You have license for. In case you have modules with license that has expired and no longer receive updates for, we will not update.
3.4 We will update plugins / modules if We have license that allows it, free of charge as a benefit to You, for the duration of Your contract with Us.
3.5 We reserve the right to access your platform/ your website at any times and conduct security checks and updates including any necessary platform or modules / plugins updates, in order to try and keep your website platform safe, outside of the scheduled maintained updates at point 3.2.
3.6 In case your website platform has been cracked or hacked, we will try and restore, clean and secure your website, while also maintaining our servers integrity. This process can take days in the worst case, depending on platform and the attack level.
